If you're true on this, it means that although Mike & Claire had the idea and were the managers of it all, the Privilege associates bore almost all the expenses and those people own the name actually then cuz they registered it. It's legal but not ethical as the creators would be without and out their creation and their original idea.

It has nothing to do then with any supposed wrong Spanish laws. I think it has much more to do with the legal but unethical behaviour of the owner/s of Privilege. End of story.

not true. as i understand it they arrived on the island and hired out the side room for a fee and then progressed onto hiring out the whole venue for a fee.
