Support for Restaurants

The local business association "La Camera de Comercio" announced on Monday its support for the businesses threatened by the new conservation and recuperation plan, revealed the previous week by the Environment Ministry.

The plan which concentrates on the coastal and natural park area of ses Salinas recommended the demolition of the five restaurants in the region, in an attempt to try and ease the strain on the local environment.

The president of the association, Juan Tur Ripoll, said the restaurants were an example of the high quality tourism that the island was desperate to capture.
He said that besides the direct effects the destruction would have on the several hundred employees of the restaurants, he said that their disappearance would have a catastrophic effect on tourism on the island.

Salinas Fine

The owners of the car park built in ses Salinas last year
have been fined 25,494 euros for opening the installation
without the appropriate licences.

The car park drew heavy criticism last year, after the owners of the land,
(Dunasal Park SL), decided to build the facility.
As well as reconditioning the ground, they also built two huts.

This was all done without the appropriate permission,
which has led to the fines.

Town Hall Support
The new planning Councillor in the Town Hall and old teacher of McBoobies, Josep Antoni Prats, has sent a report to the Coastal Department, pleading with them to legalise the five restaurants in danger in ses Salinas and es Cavallet. The five restaurants face an unclear future after a report by the Coastal Department revealed that their presence was having a serious effect on the natural dunes in the area, and that the restaurants had in fact been built on public land. It said that, at worst, they needed to be demolished but would certainly have to reduce the size of their establishment to one hundred and fifty square metres. Considering that two of the restaurants are currently over seven hundred square metres, this would be a considerable reduction.
Prats revealed in a press conference on Wednesday, that if the establishments were demolished they would be unable to be rebuilt, due to restrictive building laws now in place in the area. All of the establishments have been in existence since the 1970´s. The Councillor went on to say that he had asked for the Department to reconsider their verdict, as the destruction of the restaurants, which include Jockey Club, sa Trinxa and Malibu, would seriously effect tourism on the island. He continued by saying that the five establishments had become a symbol of excellence, and a haven for quality tourism. He said that a compromise would have to be reached.
A representative for the five businesses claimed that reducing the sizes of the restaurants was simply not an option. He claimed that reducing a seven hundred square metre establishment down to one hundred and fifty would have serious consequences on all of the restaurants, and eventually reduce them to merely beach kiosks.

Fight Back

The six restaurants under threat in ses Salinas and es Cavallet have presented the Coastal Authorities with a report, attempting to legalise their situation before the new law comes into practice. The Coastal Authority produced a damning report several months ago in which they ordered the demolition of the six "kiosks", which they claimed encroached onto public land and were damaging the dunes in the area. The protection of the natural park which is ses Salinas, has become a high priority for the Coastal Authority. In the report they said they understood the importance of the restaurants to the island, and claimed that they would be happy if the restaurants were reduced in size to around 150 sq. metres. The restaurants threatened are considerably larger than that, with official measurements as follows - Guarana - 1,049 sq. metres; Malibu - 1,452 sq. metres; Jockey - 1,097 sq. metres; Sa Trinxa - 363 sq. metres; Chiringay - 819 sq. metres; and es Cavallet 1,550 sq. metres.
The Town Hall of San Jose, who granted the original opening licenses, has stepped in to try and act as a mediator between the two groups. They said that they understood the importance of the restaurants to the tourist trade on the island, and were attempting to find a solution that would please both parties.

GEN Riposte
The environmental group, GEN, has reacted angrily to attempts by the owners of the six restaurants threatened in ses Salinas and es Cavallet to legalise their establishments.

The group has confirmed that some of the restaurants surpass the legal surface area in the area by over 450 per cent.
The owner of the restaurants, Ibifor S.A., is trying to take advantage of some legal loopholes in a law dating back to 1988.
However, the group has pointed out that the legalisation of the restaurants should have been carried out in the following twelve months of the legislation being put in place, and not nearly 20 years later.

The six restaurants in question, which include Malibu and the Jockey Club, are under threat after a report from the Coastal Authorities revealed that their situation and size were both having a considerable negative affect on the dunes in the area.

The entire ses Salinas area has now been deemed an area of natural beauty, and attempts are being made to ensure that the environmental equilibrium is maintained.

It seems that this will mean that the restaurants will have to abide by the guidelines in the report, which recommended that they are reduced to a total of just 150 square metres in size, a reduction of around 300 metres for some.

Coastal Plans
The new sustainability plan produced by the Ministry for the Environment has recommended the demolition of a number of beach side restaurants and bars. The study, carried out on the coast of San Jose, showed there were many establishments which had encroached onto public coastal land, which was collectively having a negative affect on the environment within the municipality. The study called for a revision of the plans in the construction of several hotels and restaurants situated in Cala Bassa. It also recommended the demolition of the restaurant, ses Eufabies in Cala Tarida, as well as an evaluation of all of the beach huts in the area. The restaurants/bars in Cala Tarida, Cala Moli, Cala Carbo, Cala d´Hort and ses Boques will also be reviewed. The study also demanded the removal of all fences around the coast, claiming that as well as being aesthetically displeasing, they also prevented access to certain areas of natural beauty.

Demolish Ses Eufabies! Why. The place sits on a large rock in the middle of the beach. This would be a real shame. The place has been there for years, with the same staff who are fantastic.

I can understand the Salinas bar issue because of the dunes etc, but this place isn't doing anyone any harm:evil:

not yet but i know that for example guaraná, the only one open in ses salines, had LOTS of problems to open this year (starting with the concession/rent which is a lot higher) and jockey club, which should be open already, is still closed so probably they are having problems too :!:

btw, this morning malibu was preparing to open.....

 the coastal authorites reiterate that the law will be applied to control the business in ses salines
the delegate of this organism in the balearics assures that they continue studying the options "without rushing" but he stresses that the administration is determined "to act"

Sunbed Prices
The Town Hall of San Jose is in talks with the owners of the sunbed franchises in ses Salinas and es Cavallet, to try and put an end to the abusive prices prevalent on the two popular beaches. The right to sell sunbeds and parasols on all of the beaches within the borough comes up for auction every four years. The beaches are due to come "under the hammer" today (Weds.23rd April). However, the sealed bids are only part of the process and the points system used to adjudicate the winners heavily favours those with businesses in the area, and those who have previously run the concession.
This points system ensures the owners of the land in ses Salinas - Ibifor - are guaranteed to win the permit on both beaches. The company then sells the rights to rent the sunbeds to the local restaurants at highly excessive prices. This process of re-selling also ensures these particular concessions do not have to stick to the maximum price set out by the Town Hall. For the next two years this cap is set to be €6. However, it is not uncommon for beds on these particular beaches to reach between €15 and €20, as the area tries to maintain a degree of exclusivity. The Town Hall also wants to ban the reservation of beds, a very popular tactic in the area.
The Councillor in charge of this department, Maria Angeles Mostazo, claimed she was trying to come to an amicable solution with the company. However, she warned she had the right to omit Ibifor from the concession process, an option which she would not rule out if a compromise could not be reached. She added the beaches were public property, and everyone had the right to use a sunbed at a reasonable price.
Four years ago Ibifor paid around €24,000 per concession, which they then sold on for up to €75,000 to the local restaurants in the area. The only way for these establishments to then recoup their money was to charge extortionate prices. Mostazo said she would insist Ibifor sold the concession for a figure far closer to that which they had initially paid for the concession, ensuring the restaurants were able to rent the sunbeds at a far more realistic price.

... illegal "Macro-Newsstands".

The concessions of supposedly collapsible refreshment stands of the beach
of you ses Salines do not only lack the permissions required by the law,
but they have overflowed their original function and they go expanding
progressively with total impunity.
Because of it, the Demarcation of Coasts foresees to knock down,
but since months ago anything on the processing of this plan is ignored,
what has carried the ecologists to fear a "reverse" of Coasts in its initial purposes.

No Plans for 2008

The Consell Insular admitted last week it was already too late for any action
to be taken to avoid the usual parking chaos in the natural park of ses Salinas.

The Transport Minister, Albert Prats, said the situation would be solved
at the same time as the new work to improve the entrance to the park.
This, he claimed, was still waiting for approval,
but would hopefully be started next year.

The plans include WIDENING THE ROAD,
putting all the electric and telephone cables underground,
and demolishing all of the disused buildings on the road.
Only when this was done would a car park also be built close to the beach.

Last year the owners of the disused land closest to the beach fenced off the area
and opened their own private car park, a move which was criticised by most
at the Consell. However, it seems that for this year at least they will once
again be powerless to stop such action
