Sant Antoni denied any compensation to Michael Cretu
The Council recalls that the Romanian musician built three times more
than authorizedin the license, so you are not entitled to compensation.
The developer asked for 20 million euros
SANT ANTONI musician Michael Cretu, seeking compensation of 20 million euros in damages
for having forced to demolish his mansion on a hilltop in Santa Agnès,
finally not receive any financial compensation, given that breached the license granted
to build three times more than what is allowed.
The Town Planning of Sant Antoni, Jose Ramon Torres, and the head of the Legal Services
Corporation, Mabel Navarro, announced yesterday at a press conference resolution
that will rise to the full and that is to dismiss the claim for compensation heritage
by Baloo Music, Cretu promoter, in November 2003.
Initially, 15.8 million requested, but in 2009 the application concerned increased to 20 million.
Now, the City shall obtain the required report of Consell Consultiu of Islands, a statutory body
of the Autonomous Region. The municipal resolution, together with the report of that body
Balearic must be backed by the full Consistory for the decision becomes final.
However, Cretu may resort to administrative and judicial.
2490 meters rather than 760
Mabel Navarro recalled that the case law establishes that "there shall be no compensation
in cases of perpetration of fraud [ill will] or gross negligence of the injured."
"It is undisputed that the promoter made works not covered in the license was initially,"
said the lawyer, who recalled that the permission granted, be canceled by illegally allowed
to build 760 square meters and, instead, ended up building 2,490 meters ,
ie 3.2 times more than allowed.
Therefore, the rejection of compensation occurs "in response to the intent of the sponsor,"
said the instructor of record.
Navarro said that the decision "has special relevance" the report issued at the time
by the council of Ibiza. The head of the legal services of Sant Antoni acknowledged
the "thorough and extensive 'opinions of the jurists of Consell.
The process of claim patrimonial Cretu began in November 2003.
The governing commission of the City Council agreed to hear this request in February 2004
but suspended while processing until final judgment was issued on the validity of the license
and the subsequent demolition of the house.
In August 2009 Baloo Music asked City Council to increase the amount of the claim up to
20 million euros. As of April 2010 is not lifted the suspension of the proceedings and ordered
to continue processing the case.
The City Council resolution will be full when I get the report of Consell Consultiu,
what will happen in around a month or more, according to the lawyer ventured city.
