As for Melon (.....) 2008 seems to become the year of final break-through: WATERGATE, Berlin offered him to host an own night three times a year. Also a his first RATIO?NIGHT in Munich`s DIE REGISTRATUR got confirmed for March. HIVE CLUB in Zurich confirmed recently a residency, as well as for MONZA-IBIZA !

Dear friends, colleagues and business partners,
as the current conduct of St. John Inn GmbH/Frankfurt is severely damaging to our business, we, Patrik Dechent and Ariel Giordano (promoters of the Ibizan Monza Club), feel compelled to make an official announcement.

The intention of this announcement is to protect our business interests. After the withdrawal of Dechent and Thomas Koch aka DJ T. (former co-founder and co-organiser of the Frankfurt Monza Club, and co-runner of Get Physical Music) as organisers from the Frankfurt Monza location at Berliner Str. 74, they carried on with the Monza events in various clubs in Ibiza starting in the summer of 2005. Already between 2000 and 2003, Koch and Dechent had begun to develop the international profile of the trademark by cooperating with Amnesia and Cocoon Club. Ever since then, a globally oriented concept has existed under the flagship of Monza Club Ibiza, which has been operating in countries like Germany, Spain, England, Switzerland, Italy and Uruguay since 2005, with an ever growing number of events. In order to promote these events on the basis of global distribution, DJ mix compilations have been launched and released on the prestigious label Get Physical/Berlin. For the promotion of these events and compilations, tens of thousands of mix CDs were produced and given away for free to the international crowd of Ibiza, as well as add campaigns launched in the whole of Europe involving millions of contacts, amongst other things. Internationally renowned DJs and Monza Ibiza residents such as Damian Lazarus, Heidi and DJ T. have lent their names to these compilations. Whereas our concept, just like many other event brands residing in Ibiza, was internationally oriented from the start, the operators of the original Frankfurt location, after Koch and Dechent had withdrawn, explicitly declared their intention to restrict themselves to running the club in Frankfurt only. After they had initially tried to attract a different crowd with new kinds of events, new promoters have only lately re-connected with the musical orientation that Koch and Dechent had stood for and have now started to book internationally renowned acts again.
Although the two event concepts had peacefully co-existed for years, this has irrevocably changed very recently, when the Frankfurt operators had their promoters announce the registration of a European trademark – excepting only Spain, where Dechent & Co. had done exactly that already in 2006. Lately, these promoters have been exerting massive pressure on booking agencies and event organisers to the effect that they would not cooperate with us. What is more, the Frankfurt promoters have recently notified us that they are going to charge us license fees for any event outside of Spain from now on. On the other hand, the Frankfurt promoters infringed our trademark in Spain trying to set up parties in this territory (e.g. Club Fever/Bilbao).

This course of action is inacceptable from a legal as well as a moral perspective. It is legally inacceptable because the Frankfurt operators were never the owners of the trademark nor the logo. Being the founding father of the event concept and also the person who actually gave Monza Club its name, Thomas Koch was in exclusive possession of the rights to the trademark until very recently. This is proven by the fact that Thomas Koch, in cooperation with the former graphic designer of Groove Magazine, Jochen Thamm, developed the logo at that time for the events that were organised in the location of the former Whisper club. And it is morally inacceptable not only because oral agreements between Koch/ Dechent and the operators of the Frankfurt location are being deliberately betrayed, but also because there is a clear intention here to make money out of the international brand awareness of Monza in a shameless way, at the same time trying to isolate our business. There can be no doubt whatsoever that the early stages of the Frankfurt Monza Club, organised by Koch and Dechent between 1999 and 2004, as well as the Monza events in the globally renowned Ibizan clubs Penelope, Space and Privilege of 2005 to 2007 have contributed incomparably more to the international brand awareness of Monza than did the latest events hosted in the former Frankfurt location. It was out of pure goodwill that Koch and Dechent, after their withdrawal from Frankfurt, had allowed the operators to continue using the name Monza for the Frankfurt club – under the very condition that their ambitions would never reach beyond Frankfurt. Given these facts, the trademark registration that was filed behind the backs of Dechent, Giordano and Koch, and then the charging of a license fee for any future use of the name are evidence of an attitude that anyone in the business can judge for themselves – no further commentary needed here.

In the meantime, Thomas Koch and Jochen Thamm have given away their rights to the name and the logo to Dechent. Therefore, there is no legal basis whatsoever for the trademark registration of a logo and a name to which the operators of the Frankfurt location have no rights. Now that we have been confronted with the Frankfurt operators’ aggressive attitude, we are prepared to face legal action to defend our rights if necessary.

Finally, we would like to point to the risk of confusion between the promoters of the two clubs. It has repeatedly been reported to us that people had mistakenly assumed to deal with Patrik Dechent, who is commonly known in the scene as “Monza Patrik”, but indeed were talking to the promoter of the Frankfurt location, Patrik Gavin. It appears as if the Frankfurt crew does nothing to minimise this potential of confusion, but indeed readily accepts and exploits it for their purposes.
