If this is about how to get rid of someone Chew, the devil is in the detail, the process, not who's right and who's wrong. Make sure you follow your disciplinary process to the letter particularly in relation to a fair hearings, representation and right of appeal.
If you're not replacing them and they've been there less than year, just make the post redundant and under a year attracts no pay off![]()

b) ive now taken over her old role. (and theres no way on earth shes gettin it back).
c) Company aint doing too great - which is why we might be letting the bottom feeder go soon.
now, we dont want her back, and boss was telling me the disciplinary procedure can take up to 18months with written warnings about conduct etc...
can he make her redundant? - downside being we cant legally replace her for 6 months, and theres too much work for 2 people, but not enough for 3. or possibly force her hand by offering the job full time, on half of what she earned, as she would no longer be in her old position with those responsibilities.
You need proper advice sir. The fact that in effect you've taken her post while she's on maternity leave could cause problems. You can't demote her while she's on maternity leave, so if she chooses to come back full time she'd be entitled to her full salary.
Don't think she can work 2 days a week unless you let her. I'd consider saying that doesn't work unless she resigns and goes freelance. If she goes for that and you don't want to employ her freelance, you're laughing.![]()

it was Her choice to come back and do 2 days a week, and she resigned from her old lofty position.
