Fined for having no money

I friend who is a truck driver was fined in Northern Spain because he had no money on him. Apparently under the Spanish Vagrancy laws (though I can't find anything about this on the net) your a vagrant if you don't have any hard cash on you and cards don't count.

He had to go to the nearest ATM and get some money out to pay the fine (and get his passeport back).

Can anyone confirm this is correct?

A similar thing happened to myself back in the early 90's whilst holidaying in Jersey though i wasn't fined but infact put in a St Helier Police Cell until i could prove i wasn't a penniless vagrant.
