Commercialisation
1. Short tourist stays may be commercialised in singlefamily homes as long as they are conducted by the owner or
by means of operators or any of the tourism
commercialisation channels and as long as they are offered
with the tourist services mentioned in the following article.
2. Without prejudice to the previous section, the
commercialisation of tourist stays in homes will be
understood to exist when it is impossible to accredit, in
accordance with the applicable regulations, that the contract
undertaken is in abidance with the legislation on urban or
rural rentals and any other special law.
3. The stays that are commercialised to tourists must consist
of the temporary concession of the right to use and enjoy the
entire home for periods of time no longer than two months.
Contracts for rooms or having users who have signed
different contracts in the same home shall not be allowed.
4. The requirements, conditions, limits and content of the
activity of commercialising tourist stays in homes may be
developed by regulations.
Article 51
Tourist services
1. The commercialisation of stays in homes for vacation use
must guarantee the direct or indirect provision of the
following services in order to facilitate the stay:
a) Periodic cleaning of the home.
b) The provision and replacement of bedding, linens, home
supplies in general.
c) Maintenance of the facility.
d) Customer service in the usual commercial hours.
2. In addition to the obligations imposed on all tourism
companies in article 19 of this law, the commercialiser of
tourist stays in homes must also have a 24-hour telephone
assistance service for tourists or users of the tourist service.
Article 52
Typology of homes where tourist stays may be
commercialised
1. The homes to be used for tourist stays must fall within the
typology of freestanding or attached single-family home.
For the purposes of this law, freestanding single-family
home is understood to mean a home where only one home is
permitted per plot of land. However, after submitting
the corresponding proceeding, other circumstances may be
accepted in which there is more than one home per plot of
land, as long as similar circumstances obtain. For the
purposes of this law, single-family attached homes refers to
homes located on the same plot of land subjected to the
horizontal property system or when attached single-family
homes exist in different plots of land connected by a
partition wall separating them.
2. Under no circumstances shall homes found in multifamily or attached buildings subjected to the horizontal
property system be considered independent freestanding
homes, and as a result tourist stays are forbidden in this kind
of home.
3. The freestanding or attached single-family homes in
which tourist stays may be commercialised must have at
most six bedrooms and at most 12 places.
4. To commercialise tourist stays, there must be at least one
bathroom for every three places, and in other features the
homes must abide by the urban planning parameters
applicable to them.
5. Tourist stays may not be commercialised in homes that
have not submitted the statement of responsibility upon the
start of a tourist activity to the competent administration.[/h]
